Hindu fishermen attacked on 23.01.16, pregnant women
aborted due to kick on her belly because Hindus fishing
in the river. Five Innocent minority people including
women and children were severely injured, sexually
assaulted by Muslim perpetrators at Dinajpur district.

4. Legal status:
Sree Polwan Das lodged F.I.R. being Khansama P.s case No.01, dated 01.02.2016 under section 143/447/323/307/313/354/379/427/114 of penal code against 21 perpetrators. Police could not arrest any perpetrators till writing of this report. Rather perpetrator lodged false allegation against minority victims at Birgonj police station being case No.18 dated 26.01.2016 under section 15(3)/16(2) of Special Powers Act,1974 to counter the case terrorising them to leave the country.
5. Case Summary:
On the date of attack on 23.01.2016 about 12 noon, all perpetrators most illegally equipped with iron rods, ballam,hasua, dao,lathi etc. jumped over the victims, started to beat mercilessly while they were fishing fishes in the Atrai River legally empowered by Co-operative Society vide the registration No.366 and amended No.8 giving tax to Government. As a result of abrupt attacks 5 fishermen (victims) were injured, their three fishing nests amounting to Taka 90,000/- were looted, thereafter they had been taken to nearest Medical Health Complex. The pregnant women named Ms.Arun Bala (30) wife of Polwan Das was seriously assaulted by perpetrators, result of scuffling & kick the unborn child within the womb Ms.Arun Bala died at the Hospital on 29.01.2016 during medical treatment. Mohammad Sharifiqul Islam, Sree Mondal Roy, Shree Jharu Roy, Shree Sailen Das, Shree Sawpan Das and others witnessed the incident of attack on minority fishermen. No perpetrators arrested.

On the contrary police entertained false criminal case No.18 dated 26.01.2016 from perpetrator No.4 Mohammad Salimuddin against minority victims under section 15(3)/16(2) of Special Powers Act, 1974 with a view to render those victim to quit Bangladesh.
Since these attacks on Ms.Arun Bala was brutal, she has been transferred to Pakerhat Upazila Health Complex and the said pregnant women aborted due to abrupt attacks.

6. Investigation:
Bangladesh Minority Watch team located at Dinajpur consisting Kamal Kanta Karmaker, Shymol Banarjee, Gouranga Roy, Biraj Basak, Harun-ar-Rashid Talukder, Joyanta Das, Julias Murmu rushed to the spot on 6th Feb, 16 at about 4 p.m. and took statements of victims who expressed their man-made sufferings & described how they have been physically tortured by those perpetrators that led to abortion of child on pregnant women. BDMW team enquired about how those fishermen were assaulted and how women were aborted due to attack. The team also testified the witnesses corroborated by victim women her and all the statements were video recorded. Bangladesh Minority Watch also enquired about the case No. 18 dated 26.01.2016 filed by perpetrator against minority victims is after thought & fabricated.

6. Recommendations:
Bangladesh Minority Watch is very much concerned about sudden attack on innocent Hindu fishermen at Khamarpara - Malijalghat of Dinajpur District and we demand:
1) immediate arrest of perpetrators responsible for crime and bring them to justice under the law.
1) The case registered within Khansama police station under the penal code is not proper and adequate. The offense committed by perpetrators against women is not tri able by local courts; this should have been done under the special law “Women and Children Repression Act”. The officer in charge should be asked to amend the case as per proper section of law.
2) Torture upon women and children should be investigated by the judicial officer not below the rank of District and Sessions Judge as the unborn child within the womb of women died.
3) Compensation be awarded to minority victims for their medical support who became traumatized due to attack and abortion.
4) The Minorities should be rehabilitated as per domestic and international law.
5) Freedom of religion and belief should be established.
6) The false counter case against minority victims at Birgonj P.S. should be withdrawn and the case filed by victim Polwan Das on 26.01.2016 should be taken into consideration.
7. Action:
Bangladesh Minority Watch at Dinajpur met with Superintendent of Police, Dinajpur, Oficer in Charge of Khansama police station and apprised the situation and they demanded proper and legal action against the perpetrators responsible for crime and humanity. The superintendent of Police assured the cases to be conducted without any discrimination. The bail of the victims in a false case has been granted by the court because the court deemed the case is absolutely fabricated. The lawyer of BDMW has become successful in obtaining bail of the minority victims.
